Bancorp of Rhode Island, Inc --

BARI Bancorp of Rhode Island continues to perform well. As mentioned before, the activist firm SL Capital has purchased 8% of the shares and is seeking 4 board seats. They have been successful in about 8 out of 10 previous attempts to force a sale. BARI's meeting is in May of 2007; however, BARI may decide to forego the vote and sell. I own four thousand shares. It is already up 10% since the annoucnement by SL Capital.

One of the reasons that BARI has traded up of late is that People's has announced and would likley look at BARI. Then again so to would New Alliance and Bank North.

This is a remarkable bank in that its goal is to be the most convenient bank in the area in terms of accessibility. It is open on weekends and offers free atm's. It also does some 'catchy' things like providing coin counters for easy deposit of coins. Commerce Bank seeks to become the MacDonalds of banking and appears to be well on its way. I bought a small position after hearing its presentation at the Ryun Beck Conference.

FBR ranks this bank as their number one pick. It is expanding in prime Florida areas and appears likely to be purchased in the not too distant future.Recently FFFL backed out of the KBW conference. The likelihood is that they are either discussing a merger, an acquisition or the issuing Preferred stock. All are good. FFFL has an efficiency rating of 70% which ironically makes it a better candidate for an acquirer since the acquirer would believe it could make the bank more efficient.

At present FFFL ($38.5) is particularly attractive. On the 14th January it will split 3 for 2. Its deposit premium is only 18-19% whereas the Florida franchises trade at premiums of 23 -24%. It won’t be independent in 2 years and according KBW and is worth $43 on its own right now.

Gold is the only ‘apparent safe haven’. John Paulson has put his firm’s assets into gold stocks and founded a gold fund, which is his only major winner this year. Although it is a very crowed trade and a likely bubble, it does not appear to be on the verge of bursting, at least until the world economies gain some firmer footing.
Gold is currently selling for over $1850/oz. Just a few months ago it was selling at $1300/oz., a ~40% gain in a market where very few stocks have gained at all.

According to strategic investor and commodities expert Dennis Gartman the sell-off is not a buying opportunity at all – the buying opportunity is behind us.

In fact, he thinks what’s happening right now is a classic sign of a top. “This was one of the great bubbles of our time.”

”I pay great attention to something technicans call an outside reversal – that is, the market made an all-time new high – closed on the lows of the day – then closed below the previous day’s lows. If you don’t pay attention to that and don’t liquidate you’re going to find yourself in a lot of trouble.”

In fact, Gartman is putting his money where his mouth is.

”I sold a lot of gold in the last 54 hours – I wish I had sold everything and I wish I was short.”

And he’s not alone. Trader Steve Cortes thinks the patterns in the gold chart now are eerily similar to those in 1980 – when gold completely topped out for years to come.

This bank is perhaps the most efficient in the USA. It is certainly going to go to a second step. Hernance told me I'd live to see the day that was two years ago. Although it has gone up considerably, it remains the class in the field.

This bank has been growing aggressively by buying other banks and increasing its commercial loan portfolio for several years. It remains a candidate for an even larger acquirer like the Royal Bank of Scotland, which has been a rumored acquirer several times with attendant run ups of SOV's price. In each instance the rumor was not substantiated and in fact reliably refuted on each occasion. Nevertheless RBS or another bank may well make a bid. The takeout will likely be $30-35 according to Ryan Beck.

Gabelli's dictum of not betting against Wal Mart seems particularly relevant for holders of WIN, winn dixie stores, ($7.75/share) that compete head to head with WalMart in the South. The shares are already trading near their book value;consequently, this sell rating only applies until int about $7.25/share. In addition the Time's business section ran a harsh review of the company today, November 09, 2003. (Gabelli, incidentally, also recommends not betting against China which seems reasonble as well, but that is for another day.)
